Terms of Service

These Terms of Service (“Terms”) set out the agreement between you (“you” or “the client”) and Endevr Digital (“we”, “us” or “our”) for our pay-monthly website service. They cover the design, build, hosting, security and ongoing support we provide under our monthly plans.

By subscribing to a plan, asking us to start work, or continuing to use a website we host and manage for you, you agree to these Terms. Please read them carefully and keep a copy for your records.

01. Who we are

Endevr Digital is a website service that designs, builds, hosts and maintains modern websites for businesses on a simple monthly subscription. You can reach us any time at info@endevrdigital.com or on 07546 532 987.

02. Accepting these terms

You accept these Terms when you subscribe to a plan through our checkout — including by ticking the box to confirm you have read and agree to them — or when you ask us to start work. If you are agreeing to these Terms on behalf of a business, you confirm you have authority to do so. Please don't subscribe if you don't agree to these Terms.

03. Our service

We provide an all-inclusive, pay-monthly website service. Depending on the plan you choose, this includes the design and build of your website, fast and secure hosting, an SSL certificate, regular backups, software updates, security and performance checks, and ongoing support.

Your plan may also include a set amount of content updates each month and ongoing SEO improvements. What is included in each plan is described on our website at the time you sign up.

04. Plans, pricing and what's included

Our plans and their monthly prices are shown on our Pricing page. In summary:

  • Starter Plan (£29.99/month) – a professional single-page website with hosting, maintenance, security and performance checks and an SEO-ready setup.
  • Growth Plan (£49.99/month) – everything in the Starter Plan, plus up to a 5-page website, up to 3 hours of content updates each month and ongoing SEO improvements.
  • Scale Plan (£79.99/month) – everything in the Starter Plan, plus up to a 20-page website and up to 5 hours of content updates each month. Larger custom packages can be discussed.

There are no upfront build costs and no hidden fees – just a fixed monthly payment. We may update our plans and prices from time to time; if a change affects your existing plan we will give you reasonable notice beforehand.

05. Payment and billing

Your plan is billed monthly in advance as a recurring subscription. Payments are handled securely by our payment processor, Stripe. We do not see or store your full card details.

Your first payment starts your subscription and, unless we agree otherwise, work begins once your first payment is received. Each subsequent payment is taken automatically on the same date each month.

If a payment fails, we will try to collect it again and let you know. If a payment remains outstanding, we may pause work, suspend support, or temporarily take your website offline until your account is up to date.

06. Minimum term

Your subscription has an initial minimum term of 12 months, starting from the date your plan begins. This commitment reflects the design and build work we carry out upfront, the cost of which is spread across your monthly payments instead of being charged as a large upfront fee.

If you cancel during the initial 12-month term — other than during the 14-day cooling-off period described below, or where we are at fault — the remaining monthly payments for the rest of that 12-month term become payable as a single amount.

Once the initial 12-month term is complete, your plan continues on a rolling monthly basis and you can cancel at any time, as described in “Cancelling and what happens to your website” below.

07. Building your website

Once you have subscribed, we will work with you to design and build your website. To do this we will need you to provide the content we ask for – such as text, images, logos and business details – and to review and approve the work at key stages.

We aim to have most websites ready to launch within a couple of weeks, but timelines depend on the plan and on how quickly you provide content and feedback. Delays in receiving what we need from you may extend the timeline.

08. Content updates and support

The support and content updates included with your plan (for example, changes to text, images or pages) are described on our website. Where a plan includes a set number of hours or edits each month, these are intended for reasonable ongoing maintenance and are not carried over to the following month unless we agree otherwise.

Larger pieces of work – such as significant redesigns, new functionality or additional pages beyond your plan – fall outside your included support and can be quoted separately or covered by moving to a higher plan.

09. Your responsibilities

When using our service, you agree that you will:

  • provide accurate, up-to-date information and keep your billing details current;
  • own, or have permission to use, all content you supply to us (text, images, logos and any other materials);
  • not use your website for anything unlawful, misleading, or that infringes someone else's rights; and
  • be responsible for the accuracy of the business information and claims published on your website.

10. Ownership and intellectual property

Your content and branding always remain yours. Any text, images and logos you provide stay your property, and you keep ownership of your business's brand.

During the initial 12-month term, the website we design and build for you — including its design, code and structure — remains our intellectual property and is provided to you as part of your ongoing service. Your monthly plan covers the design, build, hosting and management of that website for as long as you hold an active plan.

Once you have completed the initial 12-month term, full ownership of your website and its intellectual property transfers to you. From that point the website is yours to keep, and if you choose to leave we will provide your website files and reasonably help you move it to another provider.

Any third-party components, and any generic tools or frameworks we reuse across multiple clients, remain the property of us or their respective owners — but your website itself, and the content within it, becomes yours.

11. Domains and hosting

Where your plan includes a free domain, we will register and manage it on your behalf while you are subscribed. Your website is hosted on secure infrastructure that we manage as part of your plan.

If you decide to leave, we will do our best to help you transfer a domain that is registered in your name to another provider, subject to the registrar's rules and any fees they charge.

12. Your right to cancel (14-day cooling-off period)

If you are a consumer, you have a legal right to cancel your subscription within 14 days of signing up, without giving a reason. This is known as the cooling-off period.

Because our service involves starting work quickly, at checkout you can ask us to begin during this 14-day period. If you ask us to start and then cancel within the cooling-off period, you agree to pay a fair amount for the work we have already carried out up to the point you tell us you want to cancel.

If, at your request, we have fully completed the work within the 14 days – for example, your website has been built and made live – you will no longer have the right to cancel under the cooling-off period. After the cooling-off period, your minimum term and how to cancel are set out in “Minimum term” above and “Cancelling and what happens to your website” below.

13. Cancelling and what happens to your website

You can cancel your plan by contacting us at info@endevrdigital.com. When your plan ends, our hosting, maintenance and support end with it.

If you cancel during the initial 12-month term, the remaining payments for that term become due as set out in “Minimum term” above. Because the website is still our property during this period, it will be taken offline when your plan ends. Your own content and branding remain yours, and we will provide a copy of the content you supplied on request.

If you cancel after the initial 12-month term, ownership of your website will already have transferred to you, so it is yours to keep. We will provide your website files and reasonably help you move it to another provider, and our hosting and support simply come to an end.

14. Availability

We take reasonable steps to keep your website online, secure and performing well. However, we cannot guarantee that your website will be available without interruption, as occasional downtime can happen due to maintenance, updates or issues outside our control.

15. Liability

We will provide our service with reasonable care and skill. To the extent permitted by law, we are not liable for indirect or consequential losses, or for loss of profits, revenue or data. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law.

16. Changes to these Terms

We may update these Terms from time to time to reflect changes to our service or for legal reasons. The latest version will always be published on this page, and the “last updated” date above shows when we most recently made changes.

17. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
